38-year-old Jennifer Mustache was also arrested with Phillips in Superior, two days after Holton was found dead at a house on the 200 block of 12th Avenue East in Ashland.

Each appeared in Ashland County Circuit Court on Monday.

Phillips appeared by video in court from the Ashland County Jail. Mustache was not seen through video. Instead, her cries could be heard over the phone from Bayfield County Jail.

In a bit of a twist, the public defender for each of the defendants recused themselves from the case due to a conflict of interest with other witnesses and other cases."

Both Mustache and Phillips are facing a number of charges, including first degree reckless homicide, which carries a sentence of up to 60 years.

Each are also charged with felony intimidation of a witness, which carries of maximum of an additional 10 years behind bars.

However. Phillips has a lengthy rap sheet and could be looking at a longer prison sentence if his case goes to trial.

According to court papers, at the time of the arrest, Mustache was also found with a small amount of methamphetamine.

Both parties had their initial appearances postponed for later this month.

Phillips' former public defender said they have already exchanged emails with other attorneys to take over his case. Thus, his court date was only pushed back a week.

However, Mustache is still in the early process of getting new representation. Hence, her next date is in three weeks.
