Opening statement in the second Michael Carbo murder trial

Jurors are now hearing testimony in the second Michael Carbo Jr. murder trial on the Range.

It’s now been 38 years since Nancy Daugherty died in her Chisholm home. She was 38-years-old.

Now, in 2025, the night of her death is being laid out in court.

The man accused of killing her, Michael Carbo Jr., is on trial for a second time.

Opening statements took place on Thursday in Virginia.

The prosecution said that Chisholm never forgot about Nancy.

Assistant St. Louis County Attorney Chris Florey shared that Daugherty was a mother of two, a nurses aide, an EMT with Chisholm ambulance, and loved to ski and play softball.

Florey added, “Common sense and science will show that Carbo raped and killed Nancy.” He shared that DNA evidence from the crime scene is a match to Carbo.

The defense does acknowledge Carbo had sex with the victim, but attorney John Schmid said, “He is not guilty of murder.”

Instead, they believe another man committed that crime. A man who had been in love with Daugherty.

This will be laid out further during the rest of the trial, which is scheduled through the end of the month.

This is the second trial. Carbo was convicted back in 2022, and sentenced to life in prison. But the Minnesota Supreme Court sent the case back, saying there were errors during the first one.

Carbo was identified as a person of interest in 2020, thanks to advances in DNA analysis. The case was cold until then.
