Court Stays Two of PolyMet's Permits

Late on Wednesday afternoon, the Minnesota Court of Appeals stayed two of PolyMet's permits. The two permits are the permit to mine and the dam safety permit.

In the order issued Wednesday, it said opponents to PolyMet have issues with two things in particular that arose after the permits were issued in November of 2018.

One is the failure of the Brumadinho tailings dam in Brazil, and the second is the status of Glencore as a majority owner of the copper nickel venture. 

The court said the opponents raised "serious, justifiable concerns about the ongoing regulation of the NorthMet project," and they agree that the post-permit circumstances require close attention, review, and appropriate action by the DNR and other permitting authorities.

According to the order, the court set a hearing on October 23rd for oral arguments. The court wants the DNR to advise them on the status of post-permit developments, including the dam failure, and its consideration of whether Glencore will be added as a co-permittee.

PolyMet said in a statement, saying in part, "We are obviously disappointed that the court decided to temporarily stay the dam safety permits and the Permit to Mine. But we look forward to the October 23rd hearing to address the questions raised by the court. We are confident that the post-permit questions that lead to the temporary stay lack merit."
