The former owner of The Whistling Bird now faces sexual assault charges.
Anthony Curtis, 51, was charged with two counts of criminal sexual conduct in the first degree.
The criminal complaint says he assaulted a woman he knows on Sunday, September 9th.
This allegedly happened in her bedroom.
Sheriff's deputies arrested Curtis on Tuesday, but then he was released to the hospital for a medical condition.
In fact, Curtis went to the hospital twice, but then was re-arrested on Thursday.
He appeared in court on Monday in Virginia. Bail was at $100,000.
The prosecutor has notified the courts he plans on seeking a higher than guideline sentence, based on where the crime happened and how.
The Whistling Bird closed in 2009. It was a restaurant in Gilbert.
