The Republican Speaker of the Minnesota House is calling on a Duluth DFL legislator to resign following an incident at the Thompson Hill Rest Area.

Police reports say 55-year-old Rep. Kerry Gauthier and a 17 year-old male said they met when Gauthier placed an ad on Craig's List. Gauthier and the 17-year-old said they had consensual oral sex and that no money was exchanged.  Prosecutors decided not to file charges in the case.

In a statement issued Friday afternoon, Speaker Kurt Zellers (R-Maple Grove) called on Gauthier to resign, calling Gauthier "unfit" to serve his constituents.

"I believe we have given Representative Gauthier and the Democrat Caucus a respectful amount of time to address this situation on their own," Zellers said in the statement.  "Representative Gauthier’s actions are not becoming of a member of the House of Representatives, and today I am calling on him to resign from the Legislature."

Gauthier has not returned calls for comment since news of the incident first broke on Wednesday.
