Three men from the Iron Range are facing 4th degree assault charges, which are bias crimes.
Police in Virginia said the crime happened a year ago, near the 2nd Avenue and 8th Street south intersection.
The criminal complaint said Chad Stevens, of Mt. Iron, Randall Lee, of Aurora, and Gerald Meagher, of Virginia, allegedly beat up a man named Harry Lee Victor.
Witnesses and Victor told police that the men used racial slurs during the beating. A woman, Tara Hanka, was also hit, according to police.
The FBI had looked at the case, and determined they would not press charges. It was referred back to the local charging authority, the St. Louis County Attorney's office, who made the charging decision.
According to the court records system, the men are set to appear in court, in January.
