Appeals Court Upholds Essar Lawsuit Decision

ST. PAUL, Minn. (AP) - The Minnesota Court of Appeals says an environmental group's lawsuit over an impact study for a steel plant in northern Minnesota is without merit. The Minnesota Center for Environmental Advocacy had argued that the environmental impact statement the Minnesota Department of Natural Resources prepared for the Essar Steel Minnesota project near Nashwauk did not look seriously at how the plant could contribute to global warming. But the appeals court ruled Tuesday that the DNR followed state rules in approving the study. It affirms an Itasca County judge's ruling. The appeals judges pointed to a section of the environmental study called "Carbon Footprint" that acknowledges greenhouse-gas emissions. (Copyright 2009 by The Associated Press. All Rights Reserved.)
